What Kind Of Contract Do I Have With iMusician?
When you create an iMusician account, you agree to our Terms & Conditions, which include the Terms of Service for Digital Distribution. These terms outline your contractual relationship with us and provide a framework for the licensing and distribution of your music.
What Type of Agreement Do I Have With iMusician?
The Terms of Service for Digital Distribution are a licensing agreement that applies to each recording included in any release you pay for and submit to our team, whether it’s a single, EP, or album. In this agreement:
- You are the rights holder or legal representative of the recordings in your release. You don’t need to be the original creator of the copyright, but you must have the legal authority to administer the rights for the recordings (contracts, licenses, etc.).
- By submitting a release, you’re guaranteeing that you hold the necessary rights to distribute the recordings.
If you cannot prove ownership of the copyrights when requested by our team, this will be considered a violation of our terms of service, and we may take down your release from all streaming platforms. To avoid any issues, please take the time to go through the relevant sections of our FAQ before submitting your music to us.
Is this License Agreement Exclusive?
No, the license is non-exclusive and transferable. This means you are free to establish additional deals with other aggregators for the same release. However, you cannot distribute the same release on the same platforms through multiple distributors simultaneously.
Remember, it is your responsibility to ensure that the other agreements you may have do not conflict with ours. If we discover that a release is being distributed on the same shops through another service, we will have to end the agreement and take down the release with no possibility for a refund.
How to Manage or Terminate the Agreement
If you wish to terminate the licensing agreement for a specific release, you can request a takedown by following these steps. If you wish to terminate your overall contract with iMusician, you must close your account.
Physical Copies of the Contract
We do not issue physical copies of your contract. Your agreement with iMusician is fully outlined in the Terms & Conditions you accept when opening your account. If you are asked to provide proof of your affiliation with us (e.g., for legal or business purposes), you can present:
- A copy of our Terms & Conditions.
- An invoice from one of your iMusician purchases.
